TERMS OF SERVICE

Please read these terms carefully before using HomeFax.

Effective Date: March 1, 2026

Welcome to HomeFax. These Terms of Service ("Terms") are a legal agreement between you and HomeFax Home Integrity Reports Inc. ("HomeFax," "we," "our," or "us"). They govern your use of the HomeFax website, platform, and all related services (collectively, the "Platform").

By accessing or using the Platform in any way—whether browsing, creating an account, uploading a report, or purchasing access to a report—you agree to be bound by these Terms. If you do not agree, do not use the Platform.

We have written these Terms in plain language so that everyone who uses HomeFax understands their rights and responsibilities. If you have questions, contact us at info@homefax.ca.

1. What HomeFax Is

HomeFax is a technology platform that connects homeowners, home inspectors, and home buyers. We provide a marketplace where pre-listing home inspection reports are uploaded, analyzed, and made available to the public.

HomeFax is not a home inspection company. We do not perform inspections, employ inspectors, or produce inspection reports. The inspectors who use our Platform are independent professionals.

HomeFax provides the technology and the marketplace. The inspection work, the report content, and the professional opinions contained in each report are the sole responsibility of the inspector who produced them.

2. Who Uses HomeFax

There are several types of users on the Platform, and these Terms apply to all of them:

Visitors

Anyone who browses the Platform without creating an account. Visitors can view property listings and summary information at no cost.

Buyers

Registered users who create an account and purchase access to full Home Integrity Reports. The term "Buyer" refers to any person who purchases report access, whether they are a prospective home purchaser, a real estate agent, or any other interested party.

Homeowners

Property owners who engage an inspector to conduct a pre-listing home inspection for the purpose of having the report uploaded to the HomeFax Platform.

Inspectors

Certified home inspection professionals who upload inspection reports to the Platform and may conduct walkthroughs for Buyers. Inspector access is subject to these Terms and any additional Inspector Agreement.

3. Accounts and Registration

3.1 Browsing Without an Account

Anyone may browse the Platform and view property listings without creating an account.

3.2 Account Required for Purchases

To purchase access to a full Home Integrity Report, you must create an account. You must be at least 18 years of age. You agree to provide accurate, current, and complete information during registration.

3.3 Account Security

You are responsible for maintaining the security of your account credentials. Notify HomeFax immediately if you become aware of any unauthorized use of your account.

3.4 Inspector Accounts

Inspectors must apply for a Platform account and be approved by HomeFax before uploading reports. Approval requires current certification from the Canadian Association of Home and Property Inspectors (CAHPI) with a Registered Home Inspector (RHI) designation or equivalent recognized provincial certification.

4. How the Platform Works

4.1 Commissioning an Inspection

A homeowner engages an inspector of their choice to conduct a home inspection. The homeowner pays the inspector directly for the inspection. HomeFax is not a party to that arrangement.

4.2 Uploading a Report

After completing the inspection, the inspector may upload the report to the HomeFax Platform. Upload fees, if any, are published on the Platform at the time of upload.

4.3 Report Freshness

HomeFax will only accept reports where the inspection was conducted within the timeframe specified on the Platform. Reports based on inspections older than the published maximum will be rejected.

4.4 Listing on the Platform

Once uploaded, the property listing goes live on the Platform. A summary of the report is publicly visible to all Visitors. The full report is available only to Buyers who purchase access.

4.5 Validity Period

Each report remains live on the Platform for one hundred and twenty (120) calendar days from the date of upload, or until the property is sold or removed from the market, whichever occurs first.

4.6 No Early Removal

Once a report has been uploaded and listed on the Platform, it cannot be removed by the homeowner or the inspector before the expiry of the validity period or the sale of the property.

5. Purchasing Report Access

5.1 Tier 1 — Report View ($199)

Provides a 7-day view link to the full inspection report. The report is watermarked with your name and email. View-only; no PDF download. No liability transfer included. All sales are final.

5.2 Tier 2 — Walk-Through + Liability Transfer ($399)

Includes everything in Tier 1, plus a face-to-face walk-through with the original inspector and formal transfer of the inspector's professional liability to you.

5.3 Walk-Through Scheduling

For Tier 2 purchases, HomeFax will notify the inspector of your purchase. The inspector is expected to contact you within 48 hours to schedule the walk-through. The walk-through must be completed within 30 days of purchase.

5.4 Tier 2 Non-Performance Policy

If the inspector fails to complete the walk-through within 25 days, HomeFax will send a reminder. If the walk-through is not completed within 30 days, HomeFax will process an automatic refund and may permanently remove the inspector from the platform.

6. Payment and Refunds

6.1 Payment Processing

All payments are processed by Stripe, our third-party payment processor. HomeFax does not store your payment card details.

6.2 Refund Policy

All Tier 1 purchases are final and non-refundable. Tier 2 purchases are refundable only if the inspector fails to complete the walk-through within 30 days as described in Section 5.4.

7. Limitation of Liability

HomeFax is a marketplace, not an inspection company. We do not guarantee the accuracy, completeness, or reliability of any inspection report.

HomeFax is not liable for any deficiency, error, or omission in any inspection report. The inspector who produced the report is solely responsible for its content. HomeFax is not liable for any damage to property, personal injury, or other harm arising from reliance on any report.

Users are encouraged to conduct their own independent due diligence, including obtaining their own home inspection, before making any real estate purchase decision.

7.1 As-Is

The Platform and all content available through the Platform are provided on an "as is" and "as available" basis. HomeFax disclaims all warranties, express or implied.

8. Privacy

HomeFax collects, uses, and protects personal information in accordance with its Privacy Policy, which is incorporated into these Terms by reference.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in the Province of Manitoba.
